1. Introduction

Welcome to MedRelay ("we," "us," "our"). MedRelay is operated by Benjamin Trudel. By accessing or using the website located at medrelay.ca (the "Platform") and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

2. Service Description

MedRelay is an online telehealth marketplace that connects patients with licensed Canadian nurse practitioners ("NPs") for virtual consultations. MedRelay is a technology platform and is NOT a healthcare provider. We do not employ NPs, diagnose conditions, prescribe medications, or provide medical advice. All clinical decisions are made independently by licensed NPs using their professional judgment.

Our Platform facilitates asynchronous and video-based consultations across the following treatment categories: weight loss, erectile dysfunction, hair restoration, ADHD, skincare, women's health, men's health, and mental health.

3. Eligibility

To use MedRelay, you must:

  • Be at least 18 years of age;
  • Be a resident of a supported Canadian province (currently Ontario, Alberta, British Columbia, Saskatchewan, or Nova Scotia);
  • Have a valid Canadian health card or government-issued ID;
  • Provide accurate, complete, and truthful information in your consultation questionnaire and account registration.

4. Account Terms

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. You may not share your account or use another person's account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Payment Terms

All payments are processed securely through Stripe. By submitting a consultation request, you agree to pay the applicable consultation fee displayed at the time of submission. All prices are in Canadian Dollars (CAD) and include applicable taxes unless otherwise stated.

  • Non-refundable consultations: Consultation fees are generally non-refundable once a nurse practitioner has reviewed your case.
  • Refund if NP declines treatment: If a nurse practitioner determines that treatment is not appropriate for you and declines your consultation, you will receive a full refund.
  • Medication costs: Consultation fees do not include the cost of prescribed medications. Medication costs are determined by your pharmacy and may be covered by your private insurance.

6. Prescriptions and Pharmacy

If your NP determines that a prescription is appropriate, the prescription will be sent electronically or by fax to a licensed Canadian pharmacy of your choice. MedRelay does not dispense medications. We are not a pharmacy and do not store, handle, ship, or sell any pharmaceutical products. Your relationship with the pharmacy is separate from your relationship with MedRelay.

7. Nurse Practitioner Relationship

Nurse practitioners on the MedRelay Platform are independent contractors and are not employees, agents, or representatives of MedRelay. Each NP is independently licensed and regulated by the nursing regulatory body in their respective province. NPs are solely responsible for the clinical care they provide, including all diagnostic and prescribing decisions.

8. Not a Substitute for In-Person Care

The Platform is intended to supplement, not replace, the relationship between a patient and their primary care provider. Virtual consultations have inherent limitations compared to in-person examinations. You should continue to see your family doctor or primary care provider for routine check-ups and ongoing care needs.

9. No Emergency Services

MedRelay is NOT an emergency service. If you are experiencing a medical emergency, are having thoughts of self-harm or suicide, or believe your condition requires urgent attention, please call 911 or go to your nearest emergency room immediately. Do not use MedRelay for emergency situations.

10. User Responsibilities

You agree to:

  • Provide accurate and complete health information;
  • Not misrepresent your identity, age, or province of residence;
  • Not use the Platform to obtain medications for another person;
  • Not use the Platform for any unlawful purpose;
  • Follow the treatment plan recommended by your NP and report any adverse effects promptly.

11. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of MedRelay or its licensors and is protected by Canadian intellectual property laws. You may not copy, modify, distribute, or reproduce any part of the Platform without our prior written consent.

12. Limitation of Liability

To the maximum extent permitted by applicable law, MedRelay, its operator, affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising out of or related to your use of the Platform.

MedRelay does not guarantee that any NP will accept your consultation, prescribe any particular medication, or that treatment will be effective. Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to MedRelay in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless MedRelay and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. You may close your account at any time by contacting us. Termination does not relieve you of any obligations incurred prior to termination, including payment obligations.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.

16. Modifications

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
